Terms of Service

Welcome to Kinogaze ("we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the Kinogaze platform, web application, video generation pipelines, synthetic voice cloning features, and related services (collectively, the "Service").

By creating an account, purchasing access, or using Kinogaze, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Hard Paywall & Paid Access Model

Kinogaze operates on a hard paywall model. There is no free tier and no free ongoing plan. To access video generation, users must purchase either the one-time $5 Single Project trial or an active paid subscription plan.

2. Single Project Trial ($5)

New users may purchase a one-time Single Project for $5:

• Scope: Includes one (1) explainer film up to three (3) minutes in length, using any launch style (Dossier, Whiteboard, Lesson, Documentary, Product Ad) and any voice (standard TTS or custom voice clone).
• Eligibility: Strictly limited to one (1) Single Project purchase per user account and per payment card (tracked via Stripe card fingerprinting). Once an account subscribes to any paid plan, the Single Project option is no longer available.
• Subscription Credit: If you subscribe to any monthly or yearly Kinogaze subscription within seven (7) calendar days of purchasing your Single Project, the $5 fee will be automatically credited toward your first month's subscription payment.
• Non-Refundable: The $5 Single Project fee is non-refundable once purchased. Technical failures during rendering are covered by our free re-render policy.

3. Subscription Plans & Video Minutes

Kinogaze offers three recurring subscription tiers, billed either monthly or yearly (yearly plans include approximately 17% savings, equivalent to 2 months free):

Feature Parity Across Tiers

All core creative features—including custom script mode, exact duration targeting, voice cloning, landscape (16:9) and vertical (9:16) aspect ratios, burned-in captions, and SRT exports—are included across all tiers. Tiers differ solely by allocated generation minutes and video storage duration.

Minute Usage, Expiration & Rollover

• Monthly Expiration: Plan minutes are allocated at the beginning of each billing cycle and expire at the end of each cycle. There is no rollover of unused monthly subscription minutes, with one exception: when you upgrade (see Section 5), the plan minutes remaining at that moment are added once to your new plan's allowance and expire at your first monthly reset on the new plan.
• Minute Reservation: When a video generation job begins, the required minutes are reserved. Minutes are permanently deducted only after the film has been successfully delivered and passes automated quality verification checks.

Top-Up Minute Packs

Any signed-in account may purchase top-up minute packs (subscription not required). Top-ups are useful when plan minutes are exhausted, or when you only need a small amount of capacity:

• 10 minutes for $15
• 30 minutes for $39
• 100 minutes for $119

Top-up minutes are drawn only after plan minutes are exhausted and remain valid for twelve (12) months from the purchase date. Top-ups are non-refundable.

4. Video Storage & Data Deletion

Generated films (MP4 files, preview clips, and caption sidecars) are stored securely in Kinogaze cloud storage:

• Creator Plan: Stored for thirty (30) days from completion, after which files are automatically and permanently deleted.
• Pro and Studio Plans: Stored for ninety (90) days from completion, after which files are automatically and permanently deleted.

Users are solely responsible for downloading and backing up their completed films and captions prior to the expiration of the retention window.

5. Subscription Cancellation

• Cancel Any Time: You may cancel your subscription at any time via your account billing dashboard. Upon cancellation, recurring charges will cease, and you will maintain full access to your plan benefits and minute balance until the end of your current paid billing period.
• No Partial Refunds: Payments are non-refundable for partial billing cycles.
• Plan Upgrades: You may upgrade to a higher tier, or from monthly to yearly billing on the same tier. An upgrade replaces your current plan with a new one: your current subscription ends immediately, the new plan starts on the day you upgrade with its full minute allowance and a new billing period, and you pay the full current price of the new plan. Unused time on the replaced plan is not credited or refunded. The plan minutes remaining at the time of the upgrade are added once to the new plan's allowance and expire at your first monthly reset on the new plan; purchased top-up minutes are not affected. Downgrades, and changes from yearly to monthly billing, are not available during a billing period; to move to a lower plan, cancel renewal and choose the new plan when your current period ends.

6. Acceptable Use Policy

You agree to use Kinogaze solely for lawful, ethical purposes. You expressly agree that you will NOT use the Service to:

1. Unauthorized Voice Cloning: Upload audio or create a synthetic voice clone of any individual without that person's express, verifiable written consent and legal authorization.
2. Impersonation & Deception: Impersonate any real person, living or deceased, or falsely represent an AI-synthesized voice or persona as an authentic recording without proper disclosure.
3. Harmful & Illegal Content: Generate, upload, or disseminate content that is illegal, defamatory, libelous, fraudulent, obscene, sexually explicit, hateful, harassing, threatening, or inciting violence.
4. Misinformation: Produce synthetic news, deceptive explainers, or fraudulent material presented as objective factual truth intended to mislead the public.
5. Intellectual Property Infringement: Violate any third party's copyright, trademark, patent, trade secret, privacy, or publicity rights.
6. System Abuse: Reverse-engineer, scrape, DDoS, automate abusive requests, bypass rate limits, or exploit our rendering pipeline or infrastructure.

Kinogaze maintains zero tolerance for unauthorized voice cloning or non-consensual deepfakes. Violations will result in immediate termination of access and possible referral to law enforcement.

7. Intellectual Property & Film Ownership

• Your Ownership: As between you and Kinogaze, you own all rights, title, and interest in the completed video files and scripts you create using the Service, subject to third-party licenses described below.
• Unlisted Share Links: When you copy or share an unlisted watch link for a film, anyone who has that URL can view the film without signing in until you revoke the link.
• Third-Party Asset Licenses: Kinogaze's automated visual research may locate and incorporate archival images, public domain illustrations, or open-licensed media (e.g. from Wikimedia Commons, Openverse, or NASA archives). Kinogaze only uses photos whose license allows commercial use: public domain, CC0, or Creative Commons CC BY. Photos under share-alike (CC BY-SA), non-commercial (NC), no-derivatives (ND) or unknown licenses are excluded. Third-party assets retain their respective original licenses. You are solely responsible for complying with all applicable third-party license obligations, including maintaining necessary attributions and credits when you distribute your video.
• Platform License: You grant Kinogaze a non-exclusive, worldwide, royalty-free license to host, process, cache, and transmit your inputs and generated media strictly as necessary to provide, render, and maintain the Service.

8. AI-Generated Content Disclaimer & Publisher Responsibility

Important Disclaimer: Kinogaze uses advanced artificial intelligence and automated research to plan visuals and generate scripts and narration. AI models can hallucinate, omit critical facts, or produce factual errors.

Kinogaze does not warrant, verify, or guarantee the accuracy, completeness, or reliability of any facts, scripts, or claims contained in generated explainers. You are solely responsible for fact-checking and reviewing all scripts and visual content before publishing, broadcasting, or sharing them.

Furthermore, you are solely responsible for complying with all applicable synthetic media disclosure laws (including the EU AI Act and state AI transparency statutes) and platform-specific AI labeling rules (such as YouTube, TikTok, and Meta AI disclosure requirements).

9. Account Suspension & Termination

We reserve the right to immediately suspend or terminate your account, revoke API access, or cancel rendering jobs if you breach these Terms, engage in fraudulent billing activity, file unauthorized chargebacks, or misuse the voice cloning system. Upon termination, your right to use the Service ceases immediately.

10. Limitation of Liability & Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL KINOGAZE, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL.

KINOGAZE'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL FEES ACTUALLY PAID BY YOU TO KINOGAZE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (OR $5 IN THE CASE OF A SINGLE PROJECT PURCHASE).

11. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms shall be subject to the jurisdiction of competent courts.
